12 13 I. INTRODUCTION 14 Defendant Apttus Corporation (“Apttus”) brings a Motion to Strike or Dismiss Plaintiff’s 15 Fourth Amended Complaint Pursuant to FRCP 12(f) and 12(b)(6) (“Motion”). The Court finds 16 that the Motion is suitable for determination without oral argument and therefore vacates the 17 Motion hearing set for March 22, 2024 at 9:30 a.m. The case management conference set for the 18 same date will remain on calendar but will be conducted at 2:00 p.m. instead of 9:30 a.m. For the 19 reasons stated below, the Motion is GRANTED in part and DENIED in part.1 20 II.
