12 Pending before the Court are two motions filed by Defendant Dole Packaged Foods, LLC: a motion to dismiss and a motion to stay discovery. Dkt. Nos. 24, 36. The Court finds this matter appropriate for disposition without oral argument and the matter is deemed submitted. See Civil L.R. 7-1(b). For the reasons discussed below, the Court GRANTS IN PART and DENIES IN PART the motion to dismiss, and GRANTS the motion to stay discovery. I.
