HAYES, Judge: The matter before the Court is the Second Application for an Emergency Order Staying Enforcement of the Rincon Tribal Court Judgment Pending Appeal filed by Plaintiff Rincon Mushroom Corporation of America. (ECF No. 112). I. BACKGROUND On October 20, 2009, Plaintiff Rincon Mushroom Corporation of America (RMCA) initiated this action by filing the Complaint. (ECF No. 1). The action concerns tribal regulation of non-Indian fee simple land (the Property) located within the boundaries of the reservation of the Rincon Band of Luiseno Mission Indians (the Tribe).
