v. DISMISS FIRST AMENDED COMPLAINT [Doc. No. 51] DR., JOHN K. CHAU, Defendant. 16 Pending before the Court is Defendants’ motion to dismiss Plaintiff’s First Amended Complaint. [Doc. No. 51.] For the reasons set forth below, the motion is GRANTED. PROCEDURAL BACKGROUND On January 12, 2019, Plaintiff filed a complaint under the Civil Rights Act 42 U.S.C. §1983 against Defendants J. Chau, California Department of Corrections and Rehabilitation, erroneously sued as Richard J. Donovan Correctional Facility, California Correctional Health Care Services, G. Casian, P. Jayasundara, and F. Sedighi. [Doc. No. 1.] On April 29, 2019, Defendants filed a motion to dismiss the original complaint. [Doc.
