Defendants. [doc. no. 114] 16 Pending before the Court is Defendants’ motion to dismiss Plaintiff’s second amended complaint. Plaintiff opposed the motion and Defendants replied. To the extent Defendants raised new arguments in their reply, the arguments were not considered in this order. See Zamani v. Carnes, 491 F.3d 990, 997 (9th Cir. 2007) ("The district court need not consider arguments raised for the first time in a reply brief."). Accordingly, Plaintiff’s motion to file a sur-reply (doc. no. 114) is denied as moot. The Court decides the motions on the briefs without oral argument. See Civ. L. R. 7.1 (d.1).
