16 17 This matter is before the Court on a motion for new trial filed by Plaintiff Carl Haynes. [Doc. No. 177.] The motion has been fully briefed and the Court finds it suitable for determination on the papers submitted and without oral argument. See CivLR 7.1(d)(1). For the reasons set forth below, the motion is DENIED. I. BACKGROUND On July 26–29, 2021 and August 2, 2021, this Court presided over a jury trial between Plaintiff Carl Haynes (“Plaintiff”) and Defendant Home Depot U.S.A., Inc. (“Defendant”).
