Defendants. [ECF No. 31] 17 This matter comes before the Court on Defendants’ Motion to Dismiss pursuant to Federal Rule of Civil Procedure 41, filed on March 25, 2022. ECF No. 31. After reviewing the motion, the undersigned hereby submits a Report and Recommendation regarding the motion to United States District Judge Linda Lopez pursuant to 28 U.S.C. § 636(b)(1). For the reasons set forth below, the undersigned recommends the Court DENY the Motion to Dismiss. I.
