Presently before the Court is Defendant Hoven Vision, LLC’s Motion to Dismiss the Complaint (“Mot.,” ECF No. 10), as well as Plaintiff Jana Dillon Jamieson’s Response in Opposition to (“Opp’n,” ECF No. 11) and Defendant’s Reply in Support of (“Reply,” ECF No. 13) the Motion. The Court vacated the hearing and took the Motion under submission on the papers without oral argument pursuant to Civil Local Rule 7.1(d)(1). (See ECF No. 12.)
