15 Defendant. 16 17 18 Plaintiff Kristopher G. French, a California state prisoner proceeding IFP and pro se brings this civil rights action pursuant to 42 U.S.C. § 1983 against J. Mitchell, a Sergeant at the Richard J. Donovan Correctional Facility in San Diego, California. See Doc. No. 1. On December 19, 2022, Defendant filed an answer to the Complaint, see Doc. No. 9, and the parties are scheduled to appear before United States Magistrate Judge Allison H. Goddard for an Early Neutral Evaluation (“ENE”) and Case Management Conference (“CMC”) on February 1, 2023, see Doc. No. 10.
