Because the Court was not convinced that it even has the discretion to exercise supplemental jurisdiction over the state claims under 28 U.S.C. § 1367(a), it ordered Plaintiff to show cause why the state claims should not be dismissed. On August 21, 2023, Plaintiff responded to the order to show cause and filed a first amended complaint (“FAC”) that added a federal claim against Pacific only.
