1. Acceptance of Terms

By accessing or using Caselegis ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. We may update these terms from time to time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

Caselegis provides a legal case law search and research platform focused on California courts. The Service includes full-text search of court opinions, citation analysis, bad law detection, bookmarking, and related research tools. The Service is provided on both free and paid subscription tiers.

3. Account Registration

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorized access to any part of the Service or its systems
  • Use automated tools, bots, or scrapers to access the Service beyond normal use
  • Interfere with or disrupt the Service or servers connected to the Service
  • Resell, redistribute, or sublicense access to the Service without authorization
  • Remove or alter any proprietary notices or labels on the Service

5. Case Law Data

The case law content available through Caselegis consists of court opinions that are public domain government works. While we strive to provide accurate and up-to-date information, Caselegis does not guarantee the completeness, accuracy, or currency of any case law data. The Service should not be used as a substitute for professional legal advice.

6. Bad Law Detection Disclaimer

The bad law detection feature (Red, Yellow, Green status indicators) is provided as a research aid based on automated citation analysis. It is not a definitive legal determination. You should independently verify the current status of any case law before relying on it in legal proceedings. Caselegis is not responsible for any consequences arising from reliance on automated status indicators.

7. Subscription and Payments

Paid subscriptions are billed on a monthly basis. You may cancel your subscription at any time, and your access will continue until the end of the current billing period. Refunds are not provided for partial billing periods. We reserve the right to change subscription pricing with 30 days notice.

8. Intellectual Property

The Service, including its design, features, software, and documentation, is owned by Caselegis and protected by applicable intellectual property laws. Court opinions accessed through the Service remain public domain government works. Your use of the Service does not grant you any ownership rights to the Service itself.

9. Limitation of Liability

To the maximum extent permitted by law, Caselegis shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim arising from these terms shall not exceed the amount you paid for the Service in the twelve months preceding the claim.

10. Termination

We may suspend or terminate your access to the Service at any time for violation of these terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately. You may export your data before termination by contacting us.

11. Governing Law

These terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in California.
